Ormond Beach City Council–  A new workbook for Fiscal Year 2025 has been created to reflect Nov 6th forward. The City of Ormond Beach posts its agendas on the Friday before the Tuesday meeting. As of Apr 20th the Minutes are through 4/1/2025.

FYI – At the 7pm 4/15/25 city council meeting there was an agenda item to approve an Intent to Bid – CDBG Division Avenue North Side Sidewalk  ImprovementsAt 1:37 pm at 4/15/25 PRIOR to the council meeting the city scheduled and released notification of the pre-bid meeting for the above agenda item.  It is now obvious that the bureaucrats do what they want and OUR city commission is NOT in control, but to rubber stamp their spending.  

 

Final Goal Setting Workshop is May 6th at 5:30 pm.  City Hall 22 South Beach Street, Ormond Beach  REMEMBER- The only way to find out what is going on in a workshop is to attend.  There is no audio posted to the website and minutes can be months in arrears.  (still waiting on the minutes from the first goal setting, public art, and the stormwater workshops)
FYI – The Public Records request submitted on 3/14/25  requesting the powerpoint presentation from the First Goal Setting Workshop on March 12 & 13, is still outstanding.

If you want to see more high density growth, more traffic, less parking, more government overreach and higher taxes to pay for it all, This is the Comprehensive Plan for you.  If not, reach out to your commissioner, the mayor, and / or attend the meeting and voice your concern.  Let the city know, suggest that the city only put into the comprehensive plan the bare minimum that is legally required. To change anything in the comprehensive plan it must go through the county and the state.  Ormond Beach should controled its own destiny NOT the county or the state.

For the 5:30 Stormwater workshop the agenda packet attached.  
Per the agenda packet ” This workshop will present an overview of stormwater to the City Commission, including the City’s policies related to stormwater management and the actions taken to meet City goals.”  The overview that they will be going over is not included in the packet.
Remember the city will NOT post the audio of this meeting; it can only be requested via FOIA.  So if you want to hear what is going on before it is too late you must attend, hopefully the microphones will be used!  Still waiting on the Goal setting Workshop ( March 12 & 13) and the Public Art Workshop ( April 1) minutes.  If I were to guess the minutes for any of the workshops will not be posted until after the items are approved.

Here are some questions and concerns from the 4/15/25 agenda.  I have given the agenda item followed by concern.  As you stated in the 1/21/25 commission meeting you would be happy to meet in person to discuss issues and concerns.  I am STILL waiting for a response as to when and where are most convenient for you to meet to address my concerns.  Is it safe to assume you have no intention of meeting in person, as you stated at the council meeting, to discuss issues and concerns since it has been over THREE months and have not received any reply?

A. RESOLUTION NO. 2025-79: A RESOLUTION AUTHORIZING THE APPROVAL AND EXECUTION OF A PURCHASE AUTHORIZATION FOR THE PURCHASE OF ONE FREIGHTLINER M2 16 YARD DUMP TRUCK, UNDER FLORIDA SHERIFFS ASSOCIATION BID NO. Please explain why if the Funding in the amount of $176,619 was included in the Fiscal Year2024-25 budget, and the budget was approved why is the item being voted on AGAIN?

E. RESOLUTION NO. 2025-83: A RESOLUTION ACKNOWLEDGING THE RECEIPT OF THE 2023 ORMOND CROSSINGS ANNUAL REPORT DATED JANUARY 27, 2025; AND SETTING FORTH AN EFFECTIVE DATE.

F. RESOLUTION NO. 2025-84: A RESOLUTION ACKNOWLEDGING THE RECEIPT OF THE 2024 ORMOND CROSSINGS ANNUAL REPORT DATED JANUARY 27, 2025; AND SETTING FORTH AN EFFECTIVE DATE.  

These requests are to receive and accept the 2023 and 2024 Ormond Crossings annual reports filed by Ormond Crossings West, LLC, as required by the development agreement approved by the City Commission. Did the City Commission not have the foresight to put some type of timeline on when these reports should be received?  These reports are dated the same, and the city is only now receiving the 2023 Annual report NOW?  How can staff feel the 2023 & 2024 annual reports do not have an impact on citizens ? These reports provide information on the status of the Ormond Crossings project.  A project that will greatly increase development and traffic, put a greater strain on infrastructure, stormwater management. fire and police services.  The citizens need to be informed in a timely manner.  

G. RESOLUTION NO. 2025-85: A RESOLUTION AUTHORIZING THE EXECUTION OF A QUITCLAIM DEED IN FAVOR OF PINE25 ORMOND BEACH LLC, RELEASING ANY AND ALL RIGHTS, TITLE AND INTEREST THE CITY MAY HAVE IN AND TO THE PROPERTY GENERALLY LOCATED AT 4 SUNSHINE BOULEVARD, ORMOND BEACH, FLORIDA (PARCEL ID NUMBERS: 4218-00-03-0011 AND 4218-01-00-0730) AT THE AIRPORT BUSINESS PARK, PHASE I; PROVIDING FOR RECORDATION; AND SETTING FORTH AN EFFECTIVE DATE.  

Why was a deed restriction put in place to begin with??? The deed restriction  that ran with the land indicating the property owner could not sell, lease, assign or otherwise convey an interest in the property without the prior written approval of the seller (City of Ormond Beach).  WHY?

I  like to suggest that the city only put into the comprehensive plan the bare minimum that is legally required. As I understand, to change anything in the comprehensive plan it must go through the county and the state.  Let Ormond Beach be in control of Ormond Beach, not the county or the state.

ORDINANCE NO. 2025-18: AN ORDINANCE AMENDING SECTION 17-5, RESERVED, OF CHAPTER 17, STREETS, SIDEWALKS AND OTHER PUBLIC PLACES, OF THE CODE OF ORDINANCES; BY ADDING A NEW SECTION TITLED, PRESERVATION OF PUBLIC SPACES; PROVIDING TERMS AND CONDITIONS; AND SETTING FORTH AN EFFECTIVE DATE.  

This Ordinance is to  prohibit overnight public camping, sleeping on public grounds or property, including at public buildings or rights-of-way with limited exceptions.  This proposed ordinance DOES NOT regulate sleeping/camping during the daytime.  Please define daytime hours vs overnight ?  What are the times this ordinance is enforced?

ORDINANCE NO. 2025-16: AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF ORMOND BEACH, BY AMENDING SECTION 2-300, METHODS OF SOURCE SELECTION, OF DIVISION 3, PURCHASING, OF ARTICLE IX, FINANCIAL MATTERS, OF CHAPTER 2, ADMINISTRATION, BY AMENDING THE PURCHASING THRESHOLD FOR FORMAL BIDDING AND APPROVAL; AND AMENDING SECTION 2- 313, PAYMENT OF CLAIMS, OF DIVISION 4, RISK MANAGEMENT PROGRAM, OF ARTICLE IX, FINANCIAL MATTERS, OF CHAPTER 2, ADMINISTRATION, BY INCREASING THE CLAIMS COMMITTEE AUTHORIZATION LIMIT TO SETTLE CLAIMS; REPEALING ALL INCONSISTENT ORDINANCES OR PARTS THEREOF; PROVIDING FOR SEVERABILITY; AND SETTING FORTH AN EFFECTIVE DATE.  

At the last city council meeting a 3-2 vote in favor of this ordinance. I request the city maintains its $25,000 cap and NOT RAISE to $75,000

Even Deltona established a spending cap of $25,000 in February 2021 that requires commission approval.  Per the April 1, 2025 agenda packet Daytona Beach has a purchasing cap of $25,000, and they are nearly double the population of Ormond Beach.

Spending caps are often implemented to ensure responsible fiscal practices and to maintain accountability to taxpayers.

Here are some common reasons to implement spending caps:

  1. Promote Fiscal Discipline: By keeping the $25,000 cap, the city aims to control overspending and prevent budget deficits, ensuring that funds are allocated wisely and within means.
  2. Transparency and Accountability: The spending cap help ensure that large financial decisions involve oversight, which keeps government activities transparent.

Ormond Beach City Council –  A new workbook for Fiscal Year 2025 has been created to reflect Nov 6th forward. The City of Ormond Beach posts its agendas on the Friday before the Tuesday meeting. As of Apr 6th the Minutes are through 3/4/2025.  

City Council Stormwater Workshop is April 1st at 5:30 pm.  City Hall 22 South Beach Street, Ormond Beach  REMEMBER- The only way to find out what is going on in a workshop is to attend.  There is no audio posted to the website and minutes can be months in arrears.  ( still waiting on the minutes from the goal setting workshop )

City Council Meeting is April 15th at 7pm.  City Hall 22 South Beach Street, Ormond Beach

Per the 4/1 meeting the purchasing threshold increase will eliminate about 50 agenda items a year, said city assistant finance director, Byle. “Most items would still require a public advertisement, and all expenses would ultimately end up on the city transparency portal,” Byle said.  According to the city, expenditures between $25,000 and $75,000 will be publicly advertised on the city’s procurement portal, DemandStar, for no less than 10 days. 

Per the DemandStar website it is free for governments and we’re free for businesses,  What about the citizens???  Then only most will require a bid and all will ultimately end up on the city transparency portal

RED FLAGs I caught were:

Would eliminate about 50 agenda items.  – Last time I checked this one reason why we have a city council, to hold our city’s spending accountable.

Not all items require public advertisement. – The citizens will not even know what is going on.

The ones that are publicly advertised are on DemandStar that is ONLY free to governments and businesses.  So, unless you have a business that utilizes DemandStar you won’t see the public advertisement.

Not all would require a bid.  – Again, we will not know if our tax dollars are being spent in a responsible fiscal manner. 

Volusia County Council –  The file is from Jan 5 2023 – Apr 1 2025.      The 2024/2025 minutes are through 3/18/2025.

FEDERAL HIGHLIGHTS

The House has not yet voted on S. 1077: District of Columbia Local Funds Act, 2025 which would restore Washington, D.C.’s funding levels even though the Senate voted for it unanimously and the White House has said it supports this bill.

The House will also continue to include Rep. Stefanik (R-NY21). She had been the nominee for the US Ambassador to the United Nations, but the Trump Administration has become worried about its extremely narrow margin in the House and withdrew her nomination.

Per the agenda packet “The Capital Improvements Program has allocated $100,000 for public art each year for 5 years. There is $100,000 allocated in the current fiscal year to start selected projects immediately. ”  I enjoy art as much as anyone, but should this be a city expense? HALF MILLION DOLLARS over the next 5 years.  Should we not FIRST be focused on city infrastructure working on the flooding issues facing our city’s residents every time it rains?  
The Master Plan recommends the creation of a Mural Assistance Project that would establish a grant process for the creation of murals on private property.   I am sure that the folks that have their homes and neighborhoods flooded time and time again prefer to see their tax dollars spent on grants for murals on someone’s private property and not the city spending our tax dollars on fixing the flooding issues.  
Remember the city will NOT post the audio of this meeting; it can only be requested via FOIA.  So if you want to hear what is going on before it is too late you must attend, hopefully the microphones will be used this time !

At two prior Ormond Beach council meetings it has been mentioned that the city increases its  purchasing policy, currently capped at $25,000, before commission approval is needed. General Election April 1st

We should all be very concerned when the government tries to silence anyone, especially those we have voted for.  At the 2/18 commission meeting city staff was given direction to prepare an ordinance setting external communication rules. According to the city’s public information officer, the ordinance will not be in the 3/4/25 meeting’s agenda.  This gives us time to  let our commissioners know our position on this proposed ordinance.

·        S1176   Assessment of Property Used for Residential Purposes              An act relating to assessment of property used for residential purposes; creating s. 193.6245, F.S.; defining the term “changes or improvements made to improve the property’s resistance to wind damage”; prohibiting consideration of the increase in just value of a property attributable to changes or improvements made to improve the property’s resistance to wind damage in determinations of the assessed value of certain property; providing applicability; providing an effective date.

URGENT; ACT NOW: U.S. Representative Greg Steube (R-Fla.) has introduced legislation to abolish the United States Agency for International Development (USAID). House Resolution No. 1029 (H.R. 1029) seeks to eliminate unconstitutional foreign-aid programs that drain billions of dollars from Americans each year.

Congress ignored its constitutional bounds by passing the Foreign Assistance Act in 1961, authorizing the creation of USAID. By abolishing USAID, Representative Steube’s bill seeks to end this federal overreach and help restore constitutional adherence.

URGENT; ACT NOW: U.S. Representative Andy Biggs (R-Ariz.) has introduced legislation to repeal the National Voter Registration Act of 1993 (NVRA), also known as the “Motor Voter” Act.

The NVRA has fundamentally compromised the integrity of our electoral system by requiring states to register voters without proof of citizenship. House Resolution No. 55 (H.R. 55) seeks to repeal this unconstitutional legislation, and currently has one cosponsor, U.S. Representative Scott Perry (R-Pa.):.

H.R. 55 seeks to restore electoral integrity and state sovereignty by returning the responsibility of voter registration to the states. The NVRA imposes a federal one-size-fits-all approach, undermining the principle of federalism envisioned by the Founding Fathers and enshrined in the Constitution.

It’s crucial for Congress to restore election integrity by repealing unconstitutional federal election laws. Urge your U.S. representative and senator to do this by supporting and enacting H.R. 55. to repeal the unconstitutional National Voter Registration Act of 1993 (NVRA).

Volusia County allocates over $60 million to municipalities for stormwater projects, studies    Ormond Beach will receive $350,000 for three stormwater

studies.   More studies!  The city should use the money to fix the issuesNOT keep studying them.  Attached is the 2023 Stormwater Master Plan

 The file is from Jan 5 2023 – Oct 15 2024.  As of  Nov 11th  the county is current to Oct 15th on the action reports, Without current action reports or minutes we do not have a written record on how our elected officials voted.  The 2024 minutes are through 9/17/2024 with the exception of 9/3/2024.  I think we need to ask WHY is the county publishing the minutes out of order WHAT do they not want the public to see!

ORMOND BEACH CITY.

PATRIOTS: Here is the information and answers I received back from the email I had sent the city on October 1st .  Within the review matrix there are many policies NEW and existing that are a blueprint for the New Green Deal.  The city has Density bonuses available within the Planned Residential Development zoning district (ex Ormond Crossings). If this Comprehensive Plan goes as written it will take an act of God to get anything changed, and the Developers will make a fortune and we the citizens will be left  holding a bag of S____ !
A few highlights and outstanding issues are:Housing ElementA data and analysis section at the beginning of the file has a lot of great information.  One that really stands out is the Projected Residential Development, all the subdivisions the city is planning to put in 5,780 units.  Of these 920 are multi-family, more apartments, more traffic, more crime. there are 260 units that pay no rent, subsidized housing?
The city wants to push Planned Residential Developments via the city commission to “foster varied housing opportunities” (NEW policy 1.1.7)The city wants to promote mixed use developments, Residential in commercial areas.  (NEW policy 1.1.8)NEW Policies 1.2 thru 1.2.3 reference FL Statute 163.3177(f)(1)(b) “The elimination of substandard dwelling conditions.”making you think each of these policies are in the statute when in fact the city is embellishing and adding more layers of bureaucracy. NEW Objective 1.3 and NEW Policies 1.3.1 thru 1.3.10 are embellishing on FL statutes to grow bureaucracy and line the pockets of developers.  New Objective 1.5 DISPLACEMENT in doing a search of FL Statute 163.3177 NOWHERE is Displacement referenced.  I think they meant to reference Section 421.55 which basically states that the city must pay when they take you property.  Will verify when I have a follow up meeting with the planning department.The city further tries to blur what they are doing by taking Policies moving and renumbering them using the old policy numbers to create New Policies.

The next Volusia County Council meeting is Nov 19, 2024 at 4pm Frank T Bruno Jr. County Council Chambers, Rooms 2004/2007

Tom Leek –  No Changes since Last Week
Volusia County Council – This data is from the combination of the Volusia County Agenda, Action Report and the Minutes.  The file is from Jan 5 2023 – Oct 15 2024, but is currently filtered to show Aug 6 – Oct 15, 2024  Agenda.  As of  Oct 23rd  the county is current to Oct 15th on the action reports, Without current action reports or minutes we do not have a written record on how our elected officials voted.  The 2024 minutes are thru 6/18/2024.   I think we need to ask WHY is there such a long delay, almost 6 months, and WHY the county does not want the written minutes of the county council OUT for the public to see!There is no Volusia County Council meeting this week found online that it was cancelled!

Ormond Beach City Council  –    A new workbook for Fiscal Year 2025 has been created to reflect Nov 6th . The 2023 and 2024 data is available upon request after this week.  I have started a new file for Fiscal Year 2025.  The City of Ormond Beach posts its agendas on the Friday before the Tuesday meeting. As of Nov 6th the Minutes are current to Oct 2nd.  MEETING TONIGHT  NOV 6TH 7PM

I have located a report the City of Ormond Beach puts out monthly from the Planning Department, I have added it below “OB Monthly Development Report 11_24”.  There is a lot of great information in this report, construction residential and commercial, upcoming meetings that pertain to development and planning, and ongoing projects in the city.  

I have taken the fantastic Link Chuck sent out on the Five Families of Volusia County and put the information in a word document for easier reading if anyone is interested.
